Backflow Testing Service Agreement
This Backflow Testing Service Agreement (“Agreement”) is entered into between BlueLine Backflow, LLC (“Company”) and the customer requesting service (“Customer”).
By requesting or receiving backflow testing services, the Customer agrees to the following terms.
1. Services Provided
BlueLine Backflow, LLC provides professional inspection, testing, and repair services for backflow prevention assemblies including but not limited to residential, commercial, irrigation system, fire system, and agricultural backflow prevention assemblies. Testing services are performed according to accepted industry standards and applicable local regulations.
2. Purpose of Backflow Testing
Backflow testing is conducted to evaluate whether a backflow prevention device meets operational performance requirements at the time of testing. Backflow prevention devices contain mechanical components that may wear or fail over time. Testing verifies the device condition only at the time the inspection is performed.
3. No Guarantee of Future Performance
Because backflow assemblies contain mechanical parts including springs, seals, and check valves, their performance can change due to water pressure fluctuations, debris in water lines, aging components, corrosion, and environmental conditions.
BlueLine Backflow does not guarantee the future performance of any tested device after the inspection has been completed.
4. Repairs and Replacement
If a backflow assembly fails testing, repairs or replacement may be required. Repair success may depend on availability of manufacturer parts, age and condition of the device, and compliance with local regulations. In some cases replacement of the entire device may be recommended.
Repair costs and replacement costs are separate from testing fees unless otherwise agreed in writing.
5. Customer Responsibilities
The Customer is responsible for providing safe access to the backflow assembly, ensuring shutoff valves are operational, protecting devices from freezing or physical damage, maintaining compliance with local water authority requirements, and scheduling required annual testing when applicable.
The Customer is responsible for any municipal compliance requirements related to their property.
6. Water Shutoff
Backflow testing may require temporary shutdown of water service. BlueLine Backflow is not responsible for damages resulting from water shutdowns necessary to perform testing or repairs.
7. Access and Safety Conditions
BlueLine Backflow reserves the right to refuse or postpone service if the backflow assembly is inaccessible, hazardous conditions exist, water valves are inoperable, devices are frozen or buried, or conditions present a safety risk. Additional service charges may apply if additional work is required to access the device.
8. Testing Reports
After completion of testing, BlueLine Backflow may provide a test report, inspection documentation, and municipal compliance forms if required. Submission of test results to local water authorities may vary depending on jurisdiction.
9. Limitation of Liability
To the fullest extent permitted by law, BlueLine Backflow, LLC shall not be liable for damages arising from device failure after testing, hidden plumbing defects, pressure fluctuations, municipal enforcement actions, cross-connections outside the tested device, or plumbing system conditions beyond the tested assembly.
Testing results apply only to the device tested at the time of inspection.
10. Payment Terms
Payment for services is due upon completion of work unless other arrangements have been agreed upon. BlueLine Backflow reserves the right to charge reasonable service fees including testing fees, repair labor, replacement parts, and travel or emergency service fees. Late payments may be subject to additional charges.
11. Scheduling and Cancellations
Appointments may be rescheduled or canceled with reasonable notice. BlueLine Backflow reserves the right to charge a service fee for missed appointments or late cancellations.
12. Governing Law
This Agreement shall be governed by the laws of the State of Colorado.
13. Backflow Service Scope Notice
BlueLine Backflow, LLC specializes in the testing, inspection, and repair of backflow prevention assemblies. Our services are limited to work directly related to backflow prevention devices and cross-connection control systems.
In some cases, a backflow assembly may require plumbing modifications, replacement of piping, valve installation, or other plumbing work that falls outside the scope of backflow testing services. For the convenience of our customers, BlueLine Backflow may coordinate with local licensed plumbing contractors who are qualified to perform these services.
Any plumbing work performed by third-party contractors is not performed by BlueLine Backflow, LLC, and those contractors operate as independent service providers. BlueLine Backflow does not control, supervise, or assume responsibility for the work performed by independent contractors. Customers may choose to hire any licensed plumber of their choosing.
14. Acceptance of Terms
By scheduling or receiving services from BlueLine Backflow, LLC, the Customer acknowledges that they have read and agree to the terms of this Backflow Testing Service Agreement.
