Backflow Inspection Disclaimer & Liability Notice

BlueLine Backflow, LLC (“BlueLine”, “we”, or “our”) provides backflow testing, inspection, and repair services for residential, commercial, agricultural, irrigation, and fire protection systems. The following disclaimer outlines the limitations of backflow testing services and the responsibilities of property owners.

By scheduling or receiving services from BlueLine Backflow, you acknowledge and agree to the terms described below.

1. Purpose of Backflow Testing

Backflow testing is performed to evaluate the operational condition of a backflow prevention assembly at the time of inspection. The purpose of testing is to determine whether the device meets the applicable performance standards required by local water authorities and plumbing regulations at the time of testing.

Backflow prevention devices are mechanical assemblies containing springs, seals, check valves, and moving components that may wear over time. Testing confirms the condition of the device only at the time the test is performed.

2. No Guarantee of Future Performance

Because backflow prevention assemblies are mechanical devices, they may fail after a test due to normal wear and tear, debris or sediment in water lines, sudden pressure changes, water hammer conditions, environmental factors, corrosion, or plumbing modifications.

BlueLine Backflow does not guarantee future performance of any tested device beyond the time of inspection.

3. Inspection Limitations

Backflow testing is limited to the testing procedures required by applicable testing standards and local regulations. The inspection does not include full plumbing system inspection, underground piping inspection, irrigation system design evaluation, water pressure system analysis, or internal pipe condition inspection.

Hidden defects within plumbing systems or backflow devices may not be detectable during standard testing procedures.

4. Property Owner Responsibilities

The property owner or responsible party is responsible for maintaining backflow prevention assemblies, repairing or replacing defective devices, ensuring devices are protected from freezing or physical damage, ensuring compliance with local municipal or water district regulations, and scheduling required annual testing when required by local authorities.

BlueLine Backflow does not control municipal regulations or enforcement requirements.

5. Repairs and Replacement

If a backflow device fails inspection, repairs or replacement may be required. While BlueLine technicians may perform repairs or recommend replacement parts, repair success may depend on the condition of the device and available manufacturer components. In some cases, replacement of the entire assembly may be necessary.

6. Compliance with Local Regulations

Backflow testing requirements are typically established by local water utilities, municipalities, state plumbing regulations, and cross-connection control programs. BlueLine Backflow performs inspections according to accepted testing procedures, but local jurisdictions may impose additional requirements.

It is the responsibility of the property owner to ensure compliance with all applicable regulations. For reference regarding Colorado backflow and cross-connection control programs, information may be available through the Colorado Department of Public Health and Environment.

7. Water Service Interruptions

Backflow testing and repair may require temporary shutdown of water service to the affected system. BlueLine Backflow is not responsible for any damages resulting from water service interruptions necessary to perform testing or repairs.

8. Access to Equipment

The property owner is responsible for ensuring safe and clear access to backflow assemblies. Testing may not be possible if devices are buried or inaccessible, valves are inoperable, systems are frozen, or hazardous conditions exist. Additional charges may apply if additional work is required to access the device.

9. Limitation of Liability

To the fullest extent permitted by law, BlueLine Backflow, LLC shall not be liable for damages arising from failure of a backflow device after testing, undetected plumbing defects, water pressure fluctuations, municipal enforcement actions, cross-connections outside the tested assembly, or hidden plumbing conditions.

Testing results apply only to the specific device tested at the time of inspection.

10. Acceptance of Disclaimer

By scheduling or receiving services from BlueLine Backflow, LLC, the customer acknowledges that they have read and understand this Backflow Inspection Disclaimer and agree to the limitations described herein.
